The Eighth Circuit has expedited the college’s lawsuit against Biden’s gender identity directive

The Eighth Circuit ruled that the case brought by the Missouri Ozark College against the Biden government’s directive on gender identity will move forward quickly.

This is a decision made by the Court of Appeals on July 21 to the lawyer representing the Private Christian College of Arts and Sciences for the Defense of Freedom Alliance. The ruling was made after the Federal Court rejected the school’s request in May, which requested a temporary injunction and restraining order against the directive, which would force the college to open sex-specific dormitories and showers to members of the opposite sex.

“We appealed the decision of the district court to dismiss the case, and now the court will hear the case and speed up the trial process,” ADF Senior Counsel and Vice President of Legal Strategy Ryan Bangert told Weekly newspaper Friday.

Although oral arguments in the case are now scheduled to open in November 2021, ADF’s lawyers filed an opening statement to the U.S. Court of Appeals for the Eighth Circuit on Thursday.

College of Ozark v. Biden Challenge the US Department of Housing and Urban Development’s directive, which requires entities covered by the Fair Housing Act to not discriminate based on sexual orientation or gender identity.

The order itself is part of the executive order signed by the president Joe Biden On his first day in office, he was entitled “Protecting and Combating Discrimination Based on Gender Identity or Sexual Orientation.” It requires that the interpretation of the word “sex” in the Fair Housing Act does not discriminate based on gender identity or sexual orientation. Subsequently, the interpretation meant that female dormitories, including dormitories and shared shower rooms, were open to cisgender and transgender female residents. If they do not comply, the Ozark Academy and similar colleges may face up to six-figure fines, punitive damages and attorney fees.
