A federal judge overthrew the Democratic president Joe BidenAttempt to abolish the border policy established during the Republican presidency Donald Trump.
The policy was implemented by Trump on January 25, 2019, requiring immigrants and asylum seekers to stay in Mexico while waiting for proceedings in the U.S. immigration court. It was implemented as part of the Trump Immigration Protection Agreement (MPP) plan and implemented his administration’s goal of reducing the number of immigrants within the United States.

The court’s ruling also requires the Biden administration to submit a monthly report to the court. The report must state the total number of encounters with undocumented immigrants at the southern border of the United States and the number of immigrants deported under the “stay in Mexico” policy. Court documents stated that the report must also state the total capacity and utilization rate of US immigration detention facilities, as well as the total number of months of asylum-seekers seeking circumvention policies.
According to the “Immigration Justice” of the Catholic immigration reform organization of the United States, despite the court’s ruling, the “stay in Mexico” policy did not affect every undocumented immigrant who arrived at the southern border.
Unaccompanied children are not restricted by it, and violent criminals and other known criminals are not restricted by American or Mexican prisons. The policy also does not apply to immigrants who are known to have mental or medical health problems, or immigrants who are determined by the Department of Homeland Security that they may face persecution or torture if they remain in Mexico.

On February 12, the Biden administration promised to start processing nearly 25,000 of the estimated 70,000 asylum-seekers who were forced to wait in Mexico because of the policy.
Biden concluded registration for the MPP program and developed new guidelines requiring immigrants to register for court hearings online or over the phone. According to Reuters, before the court hearing, asylum seekers must be tested for COVID-19 in Mexico and then appear at the U.S. port of entry on a specific date.
However, a Médecins Sans Frontières spokesperson told the border report on March 9 that immigrants awaiting trial in Mexican border towns were living in “inhumane” conditions and were “looted by criminal organizations”.
Waiting immigrants are often cut off from all hometown families, laws, or social support. They also do not always have viable options for stable housing, food, money, medical care, or other social support. Agents of drug cartels can recruit or kidnap immigrants, and if their family members do not comply with their financial or criminal requirements, they can demand ransom and murder them.
However, shortly after the White House announced the change to the MPP plan, Homeland Security Secretary Alejandro Majorcas stated that immigrants should not flock to the US border.
Majorcas said in a statement: “Individuals who are not eligible at this initial stage should wait for further instructions not to go to the border.” “Due to the current pandemic, border restrictions still exist and will be enforced.”
Majorcas’s statement shows the delicate balance that the Biden administration must strike. The more humane the immigration policy of his government, the more likely it is to attract more immigrants.
