Article 230 of the “Federal Communications Regulation Act” enacted in 1996 states: “Any provider or user of interactive computer services shall not be regarded as the publisher or spokesperson of any information provided by another information content provider.”
The law has been used to create a safe haven in the United States where social media companies can create platforms for free speech without having to take full responsibility for the content that their members may post. Users of websites such as Twitter and Facebook must agree to the terms that include Section 230 before they can access these platforms.
According to the law, platforms can delete posts that they believe violate their terms or standards, as long as they act “in good faith.” Trump’s lawsuit argues that social media platforms are abusing protective measures. But it also seems to claim that Article 230 itself is unconstitutional.
Weekly newspaper A constitutional expert was contacted to clarify the arguments of the lawsuit.
Experts say that Trump’s social media lawsuit has been confusing because of trying multiple arguments at the same time, many of which have failed in previous lawsuits. Eric Goldman, a law professor at Santa Clara University, said: “They argued about everything in the sun, including the First Amendment, but they got nothing.” “Maybe he sits idly by and can get him dozens of lawsuits in front of him.
