More than a year after the current governor exceeded his powers, Michigan may soon restore some of the checks and balances of the legislature. The really awesome part of this is that the law she abused will be permanently deleted, there is no threat of veto power, and no governor will be able to use it in the future. This is a good thing. Whether it is Democrats or Republicans in the governor’s mansion, they will prevent the people of Michigan from being abused.

Article 5, paragraph 1, of the 1963 Michigan Constitution confers administrative power in Michigan to the governor.
The amended Governor’s Act of 1945, emergency powers of 1945 PA 302, MCL 10.31 and below, “[d]When a major public crisis, disaster, riot, disaster or similar public emergency occurs in the state. .. The governor can declare a state of emergency and designate the relevant area. “MCL 10.31(1). The state of emergency ceases “after the governor declares that the state of emergency no longer exists.” MCL 10.31(2).
These powers can be extended, but only if the governor obtains the approval of the legislature after 28 days. Whitmer decided at the end of April 2020 that the legislature’s approval was no longer needed, but ended the previous emergency declaration, and then signed a new shipment within the next 28 days.

The Whitmer government was sued for this, and in October last year, the Michigan Supreme Court told her that she violated the law and revoked it. She found another way to act like Fidel Castro in Great Lakes, but voters in Michigan decided to make sure she would never use the law again.

A law widely used by Governor Gretchen Whitmer in response to the coronavirus pandemic could be repealed as early as next week, after members of the U.S. State Assembly approved a petition on Tuesday.
The board voted 3 to 0, and two Democratic board members were absent to prove the unlocking of Michigan’s petition to repeal the Governor’s Emergency Powers Act of 1945.
Earlier, the board of directors reached a deadlock with a score of 2-2 following a party line, deciding whether to certify the legislative initiative. But unlocking Michigan filed an appeal with the Michigan Supreme Court, and the court ordered the board to authenticate, saying that the organization apparently collected more than 340,000 valid signatures required by state law.
The Unlock Michigan organization collected more than 300,000 signatures and asked the Michigan State Legislature to repeal the 1945 law originally used by Whitmer. According to another Michigan law, citizens can draft the language of the petition and submit it to the two houses of the Michigan legislature. If the two houses pass by a simple vote, the law is passed without the governor’s signature. The legislature can also shelve and allow the issue to be referred to voters in the next statewide election. Since the Michigan House of Representatives and Senate are still in the hands of the Republicans, this should happen at the end of this month, and Governor Whitmer will no longer be able to use this law to satisfy her authoritarian impulses.
I should note that Unlock Michigan not only drafted the language for this and collected signatures for it, but they also had to compete with the Secretary of State for the signature to be approved. In the process, the issue was referred to the Michigan Supreme Court, which told BOC to stop the mischief and approve the petition.
