The brand Lorna Jane recommends that its clothing adopt “groundbreaking Technology“Called LJ Shield, it will prevent “the transfer of all pathogens.”
A judge said in a court ruling on Friday that this statement was “exploitative, predatory and potentially dangerous.”
The brand said it accepted the court’s ruling, but insisted that it was misled by the supplier.
Bill Clarkson, CEO of Lorna Jane, said: “A trusted supplier sold us a product that didn’t perform as promised.”
“They convinced us that the technology behind LJ Shield is being sold elsewhere in Australia, the United States, China and Taiwan, and that it is both antibacterial and antiviral. We believe that we are passing on benefits to our customers.”
The Australian Competition and Consumer Commission (ACCC) filed a legal action against Lorna Jane.
After the brand started its anti-coronavirus marketing campaign in July 2020, ACCC took action.
A judge issued by the Federal Court of Australia stated that the brand “shows consumers that it has a reasonable scientific or technological basis” to file a claim.
The court fined the company for “making false and misleading statements to consumers and engaging in acts that might mislead the public.”
ACCC Chairman Rod Sims told the media British Broadcasting Corporation: “This is terrible behavior because it involves making serious demands on public health without a basis.”
He added: “The entire marketing campaign is based on consumers’ desire to better resist the global pandemic.”
The court found that the brand founder Lorna Jane Clarkson authorized and approved LJ Shield sportswear promotional materials.
She also made some statements believed to be false in press releases and Instagram videos.
It has been ordered to pay fines and issue rectification notices.
Lorna Jane cannot make any antiviral claims on its sportswear for three years-unless it has a reason to do so.
Lorna Jane was founded more than 30 years ago by Ms. Clarkson, who was born in Lancashire.
It has stores in Australia, New Zealand, the United States and Singapore.
Just a few days ago, Lorna Jane was forced to pay A$40,000 to the Therapeutic Goods Administration Drug Regulatory Agency for “suspected illegal advertising” related to Covid.
It said: “Such advertising may adversely affect the Australian community, create a false sense of security, and cause people to be less vigilant about health and social distancing.”
