- A court order on Saturday prevented the Biden administration from imposing Covid-19 vaccine regulations on employers with at least 100 employees.
- The government argued on Monday that it has clear authority to enforce the rule, and blocking it could result in loss of life every day.
- The rule was announced last week that people are increasingly returning to work and risking accelerated Covid-19 spread.
The Biden administration told the court on Monday that it clearly has the right to impose the Covid-19 vaccine rule on employers with at least 100 employees, and the court’s order issued on Saturday to block the rule could kill dozens or even hundreds of people every day .
A document submitted by government lawyers to the U.S. Court of Appeals for the Fifth Circuit stated that people are increasingly returning to work and that they may accelerate the spread of Covid-19 without rules.
The document says:
With the reopening of workplaces and the emergence of highly-spread Delta variants, the threat to workers is persistent and unstoppable.
The Occupational Safety and Health Administration (OSHA) announced the rule last week. The rule also specifies testing and masking alternatives for vaccination and a deadline of January 4. The agency stated that it is necessary to prevent 250,000 people from being hospitalized.
Republican governors, trade groups, private employers, and religious organizations have filed suits in various federal appeals courts, arguing that the government has exceeded its powers.
On Saturday, the U.S. Court of Appeals for the Fifth Circuit in New Orleans suspended the rule on the grounds of “serious statutory and constitutional” issues.
The document submitted by the government is a response to the plaintiff’s request for an injunction to permanently block the rule. Government lawyers said that this request was premature.
Government lawyers pointed out that the various cases that have been filed must be concentrated in one place, and it is not clear which court will hear these cases.
Despite legal challenges, the White House press secretary on Monday urged employers to promote vaccination.
