I never thought about it because he made it clear that he was only speaking in his personal capacity, and his actual ruling that allowed the suspension to proceed contradicted his claim that the CDC was ultra vires. This provides enough ambiguity for the government to move forward.
Because of this, the owners are now facing another lawsuit to protect their rights (and their financial situation), which could have been handled correctly the first time. Unfortunately, if this crosses his path again, there is no guarantee that Kavanaugh will not melt again.
