Consumer protectionists threatened to file another lawsuit in the bank charges dispute

This Federal Court (BGH) decided at the end of April that the bank must obtain the consent of the customer to change the general terms and conditions. The credit agency must now request approval of the current expenses after the fact. In addition, customers can claim back fees that were collected without their explicit consent.

“You have to do it yourself”

Mueller emphasized: “If we don’t see unacceptable account fees being compensated, then we will enter the second round of court.” Banks and savings banks will have to comply with BGH’s judgment. “You have to do it yourself,” Mueller demanded.

According to the preliminary findings of vzbv, a savings bank and some smaller cooperative banks have so far used reimbursement requests as an opportunity to terminate their relationship with customer accounts. In the case of Sparkasse, vzbv believes that termination is not allowed. It contradicts the statutory basic service tasks of savings banks.
