The lady named Gabriele P claimed that she didn’t know that she called this Eric Clapton – Live USA, which contains recordings of performances on eBay in the 1980s. She told the court that the list was deleted one day later.
The 76-year-old rock star’s lawyer pursued the case and sent an affidavit to the Düsseldorf District Court stating that the recordings were illegal and without Clapton’s consent.
In reply to a standard letter from Clapton’s German legal team, the woman replied: “I object and ask you not to harass or contact me further” and tell them “If you insist on requesting, please feel free to file a lawsuit.”
The injunction was submitted and the court found Clapton in favor. The woman appealed, saying that her late husband bought the record in a popular German department store in 1987, but lost. The judge said that it didn’t matter that she didn’t buy the CD herself.
The court stipulated that she must pay both parties’ legal fees, totalling £2,889. In extremely unlikely circumstances, she continues to list the CD for sale. According to German copyright law, she may face a fine of up to £212,353 or six months in prison.
Clapton’s manager, Michael Eaton, told the Guardian: “Germany is a country where pirated and counterfeit CD sales are prevalent, which has harmed the quality and misleading recordings of the industry and customers. Over the years, Eric Clapton ( Eric Clapton, along with many other major artists and record companies, successfully prosecuted hundreds of piracy cases in German courts through German lawyers and in accordance with Germany’s regular copyright procedures.
“Unless the case is debated in court, the cost is usually very small. This is what happened when this lady instructed her own lawyer. Now that the full facts of this particular case have been exposed, the intention is not to proceed with the formal German litigation. “
The woman’s lawyer told Bild that they planned to appeal again. The Guardian has contacted her legal representative for further comment.
