The latest move by Governor Greg Abbott is clearly a cautious attitude towards curbing illegal immigration in his home state of Texas. Today, Abbott announced that the law enforcement agencies under his control, especially the National Guard, will now start arresting illegal immigrants crossing the border.

“Starting from May 31, 2021, I have issued a number of announcements proving that the number of people crossing the Texas-Mexico border illegally has soared in certain counties in the state under Section 418.014 of the Texas Government Code. And institutions constitute an ongoing and imminent disaster threat to Texas,” Abbott wrote. “In order to respond to this disaster and ensure the rule of law on our southern border, more manpower is needed-in addition to the soldiers from the Texas Department of Public Safety (DPS) and one of the Texas National Guard soldiers I have deployed there. Outside-DPS needs help arresting people who violate state laws.”
“With the power and authority given to me by the Texas Constitution and laws, I hereby order the Texas National Guard to assist DPS in implementing Texas laws by arresting offenders at the border,” he ordered.
My biggest question is, once arrested, how will they deal with these illegal immigrants? They will hand them over to ICE, where they will undoubtedly be let go? Or will they stay in state and local facilities? This will become complicated, especially as the number of arrests rises. I doubt whether Texas has enough prison space to carry out this work in the long term. Having said that, I might miss part of the plan. We will have to wait for more details to see how this will happen.
In addition, you can expect a lot of opposition from the Biden administration. If the DOJ is now preparing to file a lawsuit, claiming that Texas does not have the legal power to enforce immigration laws, I would not be surprised. The left view of the federal system is that if it is something they like (weed, gun control, or illegal immigration), the states can ignore the federal government’s convenience. Otherwise, Washington rules everything.
However, I doubt whether Abbott cares about these. He seems to understand that illegal immigration is a major problem in his state, and he is willing to do something about it at all costs. If DOJ wants to hunt him down, let them do it.This won’t win Abbott’s praise on CNN, but it will continue to turn the previously blue areas of Texas into red, especially Hispanic border communities like McAllen.
