Fridays are sometimes full of surprises, and today we received a news about illegal immigration. A federal judge in Houston ruled that DACA is a long-time challenged and debated amnesty program for illegal immigrants brought to the United States as a child and is illegal. This is part of a lawsuit filed by multiple states, pointing out the unconstitutional nature of the plan.
As you may remember, the Supreme Court basically attacked the issue in the summer of 2020, because Chief Justice John Roberts was a coward and he decided to focus on how the plan ended instead of its original Is it legal to create (during the Obama era).
U.S. District Court Judge Andrew Hanen issued this latest ruling.

The illegality of DACA was obvious from the beginning. Barack Obama himself said through public appearances over and over again that he has no right to do what he does. This is part of his pressure on Congress to try to force an amnesty bill. When that didn’t become reality, he acted alone with the power he didn’t have.
As far as the merits of the case are concerned, the idea of ”suspending action” can give certain illegal immigrant groups a protected status, thereby bypassing the authorization of the legislature. This idea has never had real legal effect. However, as often happens with emotional issues, the courts, including the Supreme Court, dance around this issue, rather than saying that everyone knows that DACA is illegal.
Now, we finally have a judge who has documented this procedure. This also has practical consequences. For example, DACA is no longer a magnet for immigrants who wish to cross the border illegally (at least until some high courts intervene). One of the most tragic aspects of “sympathy” shown by illegal immigration advocates, including Joe Biden, is that it encourages dangerous, deadly behavior that ultimately makes drug cartels rich.
In any case, you can bet that the battle is not over yet. Maybe it will go back to the Supreme Court. This time, with a more conservative judge in place, they are expected to answer questions about the legality of the plan, rather than avoiding questions to rule on technical issues.
