One of the most shocking things about the Biden family’s new deportation moratorium is that Joe Biden basically admitted that it might be unconstitutional, but he would do it anyway—knowing it was illegal—because it would buy him time.
Now, the Democrats don’t seem to understand or care about the rule of law. However, when Biden swore to uphold the Constitution, it was too brazen.
George Washington University law professor Jonathan Terry has a few words to say about Biden’s actions, and he is not shy about it.
1. Terry Said he was confused The decision by the Supreme Court in June and why they did not declare it unconstitutional at the time, because the unethical behavior clearly showed that they thought it was unconstitutional. But Kavanaugh retained the suspension order with the liberal majority ruling because it will expire anyway. “This is a decision that is disconnected from the merits of the case. The unconstitutionality of the law is considered inconvenient or irrelevant because it has expired. .”
Then he accepted Biden and criticized Biden’s remarks. “Most constitutional scholarships say that it is unlikely to pass constitutional review… but several leading scholars think it is possible and worth the effort,” Biden said. Terry said that given the liberal nature of the law school, most people still say a lot about the fact that this is not in conformity with the constitution. Biden still opposes this and still violates his obligation to uphold the constitution.
Biden admitted that “most” constitutional experts he consulted said that extending the moratorium is unconstitutional. However, he stated that he was still willing to continue pursuing it because of several scholars who encouraged him.

… Surprisingly, Biden admitted that this may still be unconstitutional, but they can tie it up in court to get the money out in the meantime…

According to Terry, Biden said the quiet part aloud.
…This line will be at the beginning of an application to the Federal Court to impose an injunction on the plan. The President clearly acknowledged that they will seek a plan that may violate the Constitution and hope that the funds will be shipped out of the gate before the court terminates the plan.

…President Biden has sworn to uphold the Constitution, and he will not violate the Constitution when he can use the delay of any final order to get money out of the gate. In doing so, he admitted that he would spend federal funds without constitutional authorization.

indeed. Terry was completely right, Biden completely violated his obligations and did so openly, even announcing it when he did. As I explained before, Biden not only ignored the Supreme Court’s decision, but also ignored his team’s statement the day before, saying that they had conducted a four-fold check on legality, but could not legally prove that the suspension of evictions was reasonable.
There is so much rule of law.
